Military Divorce

Many of our clients are active duty military personnel and their spouses.
Our divorce by deposition has become very popular with our military clients, since no court appearance or travel is required. Our military clients are stationed throughout the United States, and many are deployed in other countries.

Your divorce can be filed in Virginia if one of the following is true:

one party is a member of the armed forces and has been stationed in Virginia for at least six months; or
one party is a member of the armed forces and was stationed in Virginia for at least six months immediately prior to being deployed to a foreign country; or
one party is a member of the armed forces and has been stationed for six months on a ship that has its home port in Virginia; or
one party is a resident of Virginia.

There are two main options for completing a divorce: by deposition (no court appearance), or with a brief court appearance. A spouse can make the court appearance instead of the client.

For one week and three week uncontested divorce, spouse must be available (by email or fax or in person) to sign documents agreeing to the divorce.

Three Week Divorce Requirements:

1. At least one spouse has lived in Virginia for the last six months.

2.You and your spouse have been separated at least six months (no minor children) or
one year (if you and your spouse have minor children).

One Week Divorce Requirements:

1. At least one spouse has lived in Virginia for the last six months.

2. You and your spouse have been separated at least six months.

3. You have no minor children.

Divorce by Publication Requirements:

1. You have lived in Virginia for the last six months.

2. You and your spouse have been separated at least one year
(or six months if you already have a written and signed agreement).

3. Your spouse lives outside of the state of Virginia - in any other state or country; or you are unable to locate your spouse after making diligent efforts.

Divorce by Deposition Requirements

With spouse's signature:

1. At least one spouse has lived in Virginia for the last six months.

2. You and your spouse have been separated at least six months (no minor children) or one year (if you and your spouse have minor children).

Without spouse's signature (by publication in the newspaper):

1. You have lived in Virginia for the last six months.
2. You and your spouse have been separated at least one year (or six months if you already have a written and signed agreement).
3. Your spouse lives outside of the state of Virginia - in any other state or country; or you are unable to locate your spouse after making diligent efforts.
