Divorce by Deposition

Some clients prefer to obtain their Virginia divorce by deposition because a court appearance is not required. It is also not necessary to come to our office to complete the depositions.

To complete the depositions, the client and a witness answer simple questions related to the divorce. The client’s deposition questions typically cover the basic facts of the case, including date of marriage, date of separation, children, and whether the parties have signed a separation and property settlement agreement. The witness will be asked how often he or she has spoken with the client since the separation, and whether he or she has visited the home of one of the parties since the separation. A good witness will be able to verify that the parties have not lived together for the required time period.

The divorce by deposition option is convenient for clients that are currently living outside of Virginia, in other states or countries. Many of our clients that are active duty military personnel, whether stationed in Virginia, other states, or deployed in other countries, obtain their divorce using the deposition option. Many local clients also prefer depositions rather than appearing in court.

For one week and three week divorce, spouse must be available (by email or fax or in person) to sign documents agreeing to the divorce.

Three Week Divorce Requirements:

1. At least one spouse has lived in Virginia for the last six months.

2.You and your spouse have been separated at least six months (no minor children) or
one year (if you and your spouse have minor children).

One Week Divorce Requirements:

1. At least one spouse has lived in Virginia for the last six months.

2. You and your spouse have been separated at least six months.

3. You have no minor children.

Divorce by Publication Requirements:

1. You have lived in Virginia for the last six months.

2. You and your spouse have been separated at least one year
(or six months if you already have a written and signed agreement).

3. Your spouse lives outside of the state of Virginia - in any other state or country; or you are unable to locate your spouse after making diligent efforts.

Divorce by Deposition Requirements

With spouse's signature:

1. At least one spouse has lived in Virginia for the last six months.

2. You and your spouse have been separated at least six months (no minor children) or one year (if you and your spouse have minor children).

Without spouse's signature (by publication in the newspaper):

1. You have lived in Virginia for the last six months.
2. You and your spouse have been separated at least one year (or six months if you already have a written and signed agreement).
3. Your spouse lives outside of the state of Virginia - in any other state or country; or you are unable to locate your spouse after making diligent efforts.
